The Computer Fraud and Abuse Act ("CFAA") was passed by Congress in 1984 primarily to deter computer hackers. 18 U.S.C Â§ 1030 et seq. Although the CFAA is generally a criminal statute, it does permit private parties to bring a cause of action to redress violations. Importantly, this private cause of action can serve as a valuable tool for employers to protect their intellectual and proprietary information.
