Constitutional Litigation and Compliance
Tracy advises clients regarding their constitutional rights (businesses, industry groups, individuals) and constitutional powers (governmental entities). In court, she develops sophisticated constitutional strategy at both the trial and appellate level and is well versed in federal constitutional issues, including substantive and procedural due process, the Seventeenth Amendment, and voting rights. Tracy’s experience also includes state constitutional issues, including the gift clause, expenditure clause, and separation of powers. Outside of court, Tracy counsels both public and private entities on constitutional compliance questions in consequential transactions and governmental action. Tracy is recognized as a Rising Star by Super Lawyers and the Arizona Capitol Times for her work in constitutional law.
Appellate Practice
Drawing on her experience as a law clerk at the Arizona Supreme Court, Tracy frequently represents clients in appeals, before the Ninth Circuit, U.S. Supreme Court, Arizona Court of Appeals, and the Arizona Supreme Court. Based on her experience with administrative and trial court matters, Tracy knows how to build a record to support later appeals. She also frequently represents clients as amicus curiae to promote industry objectives in cases of statewide or nationwide importance.
Governmental Relations & Administrative Law
Tracy represents both public and private sector clients in a wide variety of governmental matters. For private-sector clients, Tracy assists clients in making public records requests, responding to governmental subpoenas, advocating at administrative agencies, and helping clients understand their obligations to governmental entities. She also helps client craft model legislation to achieve industry specific goals. For public-sector clients, Tracy counsels branches of government, agencies, and political subdivisions on scope of authority and other related questions.
Election Law Challenges and Political Compliance
Throughout the election cycle, Tracy serves as counsel to candidates and political action committees regarding campaign finance compliance and complaints from the Federal Elections Commission, Arizona Secretary of State, Arizona Citizens Clean Elections Commission (i.e., Voters Right to Know Act or Prop 211 compliance), and other regulators. She also assists public officials with financial disclosure reporting.
Tracy is experienced in challenging and defending candidate or initiative petitions based on line-item and sheet wide deficiencies. She is also versed in post-election challenges to ballot initiatives on various constitutional grounds.
Healthcare Regulatory Board Matters
Tracy has represented dozens of clients in response to complaints from the Arizona Medical Board, Arizona State Board of Nursing, Arizona Board of Behavioral Health, Arizona Nursing Care Institution Administrators, and Assisted Living Facilities Managers Board, among others.
