Biography

Dan Sale helps companies, boards, and senior executives navigate their most consequential encounters with government. An investigations lawyer and strategic advisor, Dan represents clients in congressional and government investigations, enforcement proceedings, internal investigations, and complex litigation. His practice often sits at the intersection of legal, political, regulatory, reputational, and business risk, and clients turn to him to help navigate that broader landscape when the stakes are highest.

Dan frequently serves as a strategic quarterback when a single problem creates exposure across multiple fronts. He sees the entire field, helping clients understand not only the immediate legal problem, but how decisions made in one arena may create consequences in another. Drawing on a background in white-collar investigations and government enforcement, Dan works with clients and their other advisors to develop the facts, assess risk, anticipate what may come next, and coordinate legal, regulatory, political, governance, communications, and business considerations into a coherent strategy. His work often begins before a formal investigation is underway, helping clients identify vulnerabilities and manage emerging risks before they become crises.

Congressional investigations are a particular focus of Dan’s practice. He has represented companies, institutions, boards, and executives in investigations conducted by both Republican- and Democratic-led committees on a wide range of subjects. Dan brings a white-collar investigator’s perspective to these matters: rigorous attention to facts, documents, witnesses, privilege, exposure, and potential parallel proceedings, coupled with an understanding that congressional investigations unfold in a uniquely political and public forum. He helps clients navigate the full arc of congressional scrutiny—from anticipating and responding to investigative demands through interviews, testimony, and hearings, as well as the government, litigation, and reputational consequences that may follow.

A significant part of Dan’s practice is preparing executives and other senior leaders for testimony, interviews, hearings, depositions, and other high-stakes appearances. His approach goes beyond mastering facts and anticipating questions. Dan works with witnesses to develop command of the record, sharpen judgment and messaging, and communicate clearly and credibly under pressure—particularly when the audience extends beyond the questioner to regulators, lawmakers, employees, investors, the media, or the public.

Dan’s experience spans a broad range of industries and legal issues, with particularly deep experience in the pharmaceutical, medical device, healthcare, and life sciences sectors. Over the course of his career, he has advised clients facing scrutiny from Congress, the Department of Justice, state attorneys general, federal regulators, and foreign authorities, as well as related civil litigation. His matters have included alleged violations of the Anti-Kickback Statute, the False Claims Act, and the Foreign Corrupt Practices Act, along with allegations of corporate and financial misconduct, healthcare and regulatory violations, consumer protection and privacy issues, and other sensitive matters carrying significant legal and business consequences.

Across his practice, Dan is known for distilling complicated problems into clear strategic choices and for building credibility with executives, boards, regulators, enforcement officials, and other decision-makers. Whether an investigation is already underway or a client is trying to anticipate what may be coming, his focus is the same: understand the full risk landscape, assemble the right team, and help the client make sound decisions under pressure.
