Biography

Randy Moore represents clients in complex product liability, commercial, class action, and admiralty/maritime litigation. His trial and litigation experience includes the defense of product manufacturers in maritime, wrongful death, catastrophic personal injury, general commercial, class action, and consumer warranty cases in federal and state courts. Randy also counsels product manufacturers on compliance with state and federal regulations and industry standards, and advises them on product liability preventative measures, safety recalls, warnings, product operation manuals and warranties. Randy also serves as a private arbitrator, mediator, and discovery referee on civil disputes in state and federal courts.

Trial & Litigation

  • Obtained several involuntary dismissals for multi-level marketing company in multi-state and single state consumer class actions
  • Defended juvenile products manufacturer in national and state consumer class actions
  • Obtained defense jury verdict for a recreational boat manufacturer in a multi-million-dollar breach of contract/warranty action involving a large yacht
  • Obtained summary judgment for a recreational boat manufacturer in a multi-million-dollar commercial dispute relating to the alleged breach of dealership agreements
  • Obtained involuntary dismissals for several ski boat manufacturers in a nationwide putative class action lawsuit seeking to preclude them from selling boats without certain design features and warning labels
  •  Obtained summary judgment for a recreational boat manufacturer in a wrongful death action arising out of a boating fatality that occurred on a 14-mile inland Mexican river based on an unconventional application of the federal Death on the High Seas Act. Successfully opposed Plaintiff’s appeal of the trial court’s ruling before the California Court of Appeal, which found in its published opinion that this body of water constituted the “high seas” under the Act
  •  Represented an individual limited partner in a multi-million-dollar fraud and breach of contract action

Safety and Compliance Counseling

  • Developed, implemented and managed a national counsel product safety program for a global manufacturer of fall protection equipment
  • Developed and implemented a national counsel litigation program for a foreign automotive manufacturer for all consumer warranty cases filed against it in the United States
  • Developed a national warranty and product return program for a major clothing manufacturer and its independent retailer network

Mediation & Arbitration Practice

  • Presided over numerous mandatory attorney’s fee arbitrations filed with the Orange County Bar Association
  • Presided over numerous civil cases as a settlement officer or private mediator
