Legal Alert: Failure to Preserve and Produce Relevant Electronic Records Can Lead to Significant Sanctions
Two recent trial court decisions in Arizona demonstrate that the failure to preserve electronically stored information (ESI) or other records, once the duty to do so has been triggered, raises the issue of spoliation of evidence and its consequences. In addition, the failure to conduct appropriate searches for relevant available ESI can lead to sanctions as well. This Legal Alert discusses those cases and corresponding practice pointers.
