Employee Benefits Update – August 2009

The Health Information Technology for Economic and Clinical Health Act (the "HITECH Act"), which was part of the American Recovery and Reinvestment Act of 2009, made some significant changes to the privacy and security requirements under the Health Insurance Portability and Accountability Act of 1996 ("HIPAA"). Many of these changes will become effective on February 17, 2010 or later, but one important change involving new notification requirements for breaches of unsecured protected health information ("PHI") will become effective on September 23, 2009.
