Brett Tobin

Brett Tobin is an associate in the Litigation, Investigations, and Trials Practice Group. He represents clients in a wide variety of commercial and tort litigation matters, having litigated cases from inception through resolution in various states, including Arkansas, Colorado, Iowa, Illinois, Montana, and New Mexico. Many of these cases were multimillion-dollar personal injury, wrongful death, or professional liability matters alleging individual or broadscale organizational negligence. He is experienced in internal investigations, administrative hearings, all aspects of discovery, expert witness development, and strategic pretrial motions practice.

Brett has a particular interest in healthcare professional liability. Influenced by family members in healthcare, he is dedicated to representing physicians, hospitals, and other healthcare providers in professional liability matters.

Before entering private practice, Brett served on active-duty in the United States Army Judge Advocate General’s Corps (JAG Corps), where he held several roles, including Trial Counsel, Special Assistant United States Attorney, Administrative Law Attorney, Government Contracts and Fiscal Law Attorney, and Legal Assistance Attorney. His government experiences exposed him to a broad range of legal matters, including administrative and criminal investigations, government contracts, estate planning, environmental law, employment law, and real property issues unique to federal enclaves. While in the JAG Corps, Brett served as first or second chair trial counsel prosecuting crimes punishable by general and special courts-martial under the Uniform Code of Military Justice, and advocated on the United States’ behalf in hundreds of federal criminal proceedings from arraignment through sentencing on crimes ranging from criminal trespass to drug trafficking and child abuse.

Before the JAG Corps, Brett served as a judicial law clerk to the Honorable Susan M. Brnovich of the U.S. District Court for the District of Arizona and as an Honors Law Clerk with the Federal Bureau of Investigation in Washington, D.C., and Milwaukee, Wisconsin.
