Agencies Publish Guidance on Pre-Existing Condition Exclusions, Lifetime and Annual Limits, Rescissions and Other Patient Protections

On June 28, 2010, the Departments of Health and Human Services, Labor and Treasury published interim final Regulations (the "Regulations") implementing the new prohibitions on pre-existing condition exclusions, lifetime and annual limits and rescissions of coverage. These new Regulations were issued pursuant to the Patient Protection and Affordable Care Act as amended by the Health Care & Education Reconciliation Act of 2010 (collectively, the "Act"). The new Regulations also provide guidance on the patient protection provisions of the Act that relate to choice of medical and emergency care providers. The new Regulations are effective August 27, 2010.
