The Supreme Court’s recent decision in Wal-Mart Stores, Inc. v. Dukes, 2011 U.S. LEXIS 4567 (2011) has undoubtedly introduced additional downside risk for aspiring class members and the plaintiffs’ class action bar, while adding new arrows to defense counsels’ quiver and strengthening old ones. The nuts and bolts reality of the Supreme Court’s decision is that company-defendants should fear class actions less and pay fewer dollars to settle such actions.
