The number of retaliation claims filed with the Equal Employment Opportunity Commission ("EEOC") is rising exponentially. According to EEOC data, retaliation charges more than tripled between 1992 and 2009. Retaliation claims now comprise 36% of the total charges filed. The reason for this rise in retaliation claims is simple – retaliation claims are easier to prove and the damage awards are often higher than claims of discrimination. This article will offer employers suggestions on how to prevent – and defend against claims of retaliation.
