Under Construction – October 2022

Oct 18, 2022

Welcome to the fall edition of our Under Construction newsletter. I trust you are enjoying the fall weather and colors.

In this newsletter, we explore various topics related to current construction trends and legal news that may be relevant to you and your business.

We include articles about Arizona’s Supreme Court’s new opinion on implied warranties for newly constructed homes, Colorado’s incentives for creating innovative housing construction, Utah’s actions on attorney fees and making unrealistic demands, managing construction market volatilities, and much more. We’ve covered a wide range of concepts in the below articles and have tried to convey what we think would be helpful to you and what you may want to know.

The construction group would also like to welcome two additions to the team – Laurie R. Hager (Portland) and Laurie Choi (Denver).

Laurie R. Hager focuses her practice on commercial real estate and leasing, construction, enforcement of creditors’ rights, and insurance coverage. She regularly assists clients with contract disputes, negotiations, and resolutions. Additionally, Laurie represents clients in federal and state courts, arbitration, and mediation. Laurie is a member of the Oregon State bar and currently serves as an Executive Committee Member of the Construction Law section.

Laurie Choi has a background in construction management, general contracting, and civil and environmental engineering, and provides clients with practical and strategic solutions for real-world construction issues. She counsels clients through construction contract drafting and negotiation, resolution of disputes arising from construction projects, legal advice for providing construction services, filing and bonding around mechanic's liens, and other construction concerns. Laurie obtained her Nevada General Contractor's License in 2009. She now focuses on the practice of law in both Colorado and California.

Another important note is that Snell & Wilmer’s Phoenix office is moving to CityScape, effective October 24, 2022. The new address is 1 E. Washington St, #2700, Phoenix, AZ 85004.

We hope you will find these articles informative and enlightening. Please let us know if you want us to address a specific construction issue in a future newsletter. We hope you have a profitable, busy, safe, and enjoyable fall season!

Best Regards,
Jim Sienicki
