Under Construction – December 2010

Dec 15, 2010

In our final issue for 2010, Under Construction is pleased to publish a special federal contracting edition. Our first article Expanding Into Federal Contracting Work—Issues to Consider by attorney Mike Yates highlights important considerations for federal contractors with regard to federal rules and regulations on wages, fringe benefits, procurement, equal employment opportunity provisions and arbitration agreements. In So, Are We Married, Dating, or What? Avoiding Affiliation in Government Construction Contracts attorneys Brett Johnson and I cover several important issues that construction companies must consider to avoid the negative effects of being determined to be "affiliated" companies. Attorney Josh Grabel highlights new ways the federal government is monitoring contractors more closely in his article Trends in Federal Contracting: Federal Government Cracks Down on Improper and Fraudulent Conduct by Contractors. In our final article of the federal contracting special, attorneys Gerard Morales and Stephanie Leach remind us that Federal Contractors Must Notify Employees of Their Rights Under Federal Labor Laws. Our firm will be presenting seminars on federal contracting starting in February 2011. Please anticipate our seminar information being circulated in January.

Outside of the federal contracting arena, Under Construction keeps you informed about developments in construction law with the articles MBE/WBE Preferences in California Public Contracting by attorneys Stuart Einbinder and Colin Higgins; The Use of LEED, Integrated Project Delivery and Building Information Modeling in Nevada by attorney and LEED Green Associate Leon Mead; and finally Colorado Court of Appeals Expands Scope of Disbursements Covered By Trust Fund Statute by attorney Scott Sandberg.

If you have questions or comments about any of these articles, you can e-mail the attorney who authored the article or your regular Snell & Wilmer contact. If you have any suggestions for future articles, please feel free to e-mail them to me. Wishing you a healthy, happy and prosperous 2011.

Sincerely,
Jim Sienicki
