On Oct. 30, 2009, the Centers for Medicare and Medicaid Services ("CMS") issued its final 2010 Calendar Year Outpatient Prospective Payment System Rule (the "2010 Rule") that provides some additional changes and clarifications regarding the "direct supervision" requirements first proposed in CMS' 2009 Calendar Year Outpatient Prospective System Rule (the "2009 Rule") and in CMS' proposed 2010 Rule issued in July.
