Kevin has significant experience with will and trust validity and interpretation issues, estate and trust administration issues, undue influence and financial exploitation of vulnerable adults, capacity issues, complex trust and estate tax disputes, trust modifications, trust jurisdictional controversies, fiduciary fee disputes, the characterization of property in trust and estate disputes, and disputes over state and federal gift and estate tax reporting.
Kevin’s trust and estate administration practice involves representing fiduciaries, beneficiaries, and heirs in the proper administration of trusts and estates. Whether it includes advising a trustee or personal representative of their rights and duties or a beneficiary of what they can and should expect from their fiduciary, Kevin’s knowledge of the law governing the estate and trust administrative process helps him guide clients, educate the other side, and avoid court to resolve disagreements if possible. Kevin also provides advice on gift and estate tax issues, including the proper reporting to applicable taxing authorities.
Kevin’s estate planning practice involves ascertaining clients’ estate planning goals and and then implementing those goals. Kevin assists clients with establishing foundational estate plans, which include wills, powers of attorney, and revocable trusts, along with more complex estate planning instruments including irrevocable trusts, gift trusts, intentionally defective grantor trusts, spousal lifetime access trusts, charitable trusts, and more. Kevin employs the use of non-profit entities, including private foundations and donor advised funds, and for-profit entities, including family limited liability companies and partnerships. Kevin also helps clients planning to sell their business do so tax efficiently.
