Biography

Dalmacio V. Posadas, Jr. is an associate in the firm’s Litigation, Investigations, & Trials group. His practice involves all areas of commercial litigation in state and federal courts, including products liability, trade secret misappropriation, unfair competition, class actions, and government compliance and investigations, among others. Dalmacio is also committed to public service and maintains a pro bono practice wherein he has represented several clients in civil rights actions in federal court and the Ninth Circuit.

  • Defended international financial institution in FINRA arbitrations
  • Defended an insurance company against trade secrets, misappropriation, and wrongful termination actions in federal court
  • Successfully defended breaches of contract and duties actions against a mortgage broker through dispositive motion practice
  • Successfully argued against a demurrer to a Cross-Complaint for violation of Business and Professions Code section 17200, among other claims, which resulted in a favorable settlement agreement
  • Successfully litigated pro bono action regarding Fourth Amendment violations in federal court that resulted in a favorable settlement
  • Successfully negotiated favorable settlement in pro bono Ninth Circuit civil rights appeal against the California Department of Corrections
  • Successfully represented client in Anti-SLAPP litigation resulting in a dismissal of the action with prejudice
  • Successfully negotiated favorable settlement agreement for client in construction site injury action
  • Successfully represented five female employees of a large advertising agency for employment discrimination based on age, sex, and gender, and harassment, wrongful termination, and wage disparity, which resulted in a multi-million-dollar settlement
  • Represented entertainment production company in breach of contract and fraud claim
  • Successfully negotiated the transfer of website domain name under the Anticybersquatting Consumer Protection Act
  • Represented mortgage broker in administrative proceedings in several states and in the Consumer Fraud Protection Bureau
  • Defended real estate developer in a complex case involving multiple properties and parties
