Carlos A. Sugich
Partner
Carlos Sugich is a partner in the firm's Real Estate and Commercial Finance practice group and co-manages the firm’s Los Cabos Office. He is admitted to practice law in both the United States (Arizona) and throughout Mexico and is currently the Vice-Chair of the Mexico Law Committee of the American Bar Association’s Section of International Law. Carlos practices primarily in the areas of real estate investment, financing and development in both the U.S. and Mexico. In addition, he regularly advises domestic and foreign clients in the documentation and organization of a variety of cross-border ventures primarily in connection with the representation of U.S. and Canadian businesses with transactions and operations in Mexico and Latin America, and Mexican and Latin American companies with transactions and operations in the U.S. Carlos has experience with NAFTA regulation, foreign investment regulated by the U.S. and Mexican governments and cross-border dispute settlement. He is a frequent speaker on cross-border transactions and Mexican law.

Uniform Commercial Code secured commercial lending in connection with real estate developments in the United States Representation of developers and construction companies regarding all aspects of real estate projects along Mexico’s coasts Representation of U.S. lenders in connection with real estate secured cross-border loans in Mexico Representation of a publicly held company in connection with its retail operations across the U.S. Representation of one of the largest loan servicers of commercial mortgage loans in the U.S. in connection with regulatory issues concerning servicing of securitized loans secured by real property in Mexico Advised a publicly held mining company in the negotiation, due diligence, corporate incorporation, and acquisition of mining claims in Mexico Assisted a U.S. based company in the lease negotiation, preparation, registration and title insurance covering the leasehold interest, in connection with the acquisition of a maquiladora plant located in Mexico Conducted several transactions regarding the acquisition of beneficiary rights and the creation of real estate trusts for real property located in the "Restricted Zone" in Mexico, and title insurance on the same rights Cross-border corporate restructuring of a U.S. based corporation with multiple subsidiaries in Mexico and other tax and general business law related issues Prepared arguments for a multinational corporation against a revocation of a purchase order by the U.S. government in light of its rights under NAFTA Chapter 10 Government Procurement
