Recently, the U.S. Equal Employment Opportunity Commission (“EEOC”) weighed in and provided guidance on the Coronavirus for employers. Click here to access the EEOC’s update and here to access the EEOC’s guidance on Pandemic Preparedness in the Workplace and the Americans with Disabilities Act. In sum, the EEOC emphasizes that employers should still be cognizant of their obligations under the Americans with Disabilities Act (“ADA”) and the Rehabilitation Act – even during a pandemic – including with regard to reasonable accommodations and medical examination and inquiry rules. Notably, the EEOC highlights that the ADA and Rehabilitation Act rules do not interfere with or prevent employers from following the guidelines and suggestions made by the CDC, found here.
