ADOSH Continues to Extend the Time Period for a Repeat Violation

When considering whether to admit to an ADOSH OSHA citation, keep in mind the changing time periods for a repeat citation. A repeat citation is issued when the employer has been cited previously for the same or substantially similar citation and that citation has become a final order.  Prior to January 2018, the statute of limitations in Arizona was one year from the date of the final order.  As of January 2018, in was lengthened to two years and it will be extended to three years on January 1, 2019.

Based on this extension of the statute of limitations for a repeat citation, employers face a greater risk of further liability with significantly greater penalties. Thus, it is more important than ever to ensure that all possible defenses have been examined before admitting to any OSHA citation.
