Justin Cochran’s commercial litigation practice primarily concentrates on representing financial institutions before state and federal courts. He routinely represents national banks, federal savings and loan associations, and other members of the lending industry in matters involving liability under common law misrepresentation and breach of contract, as well as government criminal and regulatory investigations and enforcement actions. Justin actively defends clients under statutes such as Nevada’s Unfair Lending Practices Act, the Real Estate Settlement Procedures Act, the Truth in Lending Act, the Fair Credit Reporting Act and the Fair Debt Collection Practices Act. He has defeated claims before the trial courts based on federal preemption under the Home Owners’ Loan Act and National Bank Act. Justin also has effectively removed cases to federal court following several months of litigation and successfully defended against motions to remand.
